The following is a statement from POST Executive Director Enrique Zuniga:
“The Massachusetts Peace Officer Standards and Training Commission (POST) has reached a settlement agreement stemming from a lawsuit brought by Scott Hovsepian et al. (certain members of the law enforcement community). POST entered into the agreement to avoid further litigation, and the agreement expressly affirms that POST denies any liability.
Although the lawsuit alleged that POST violated the Open Meeting Law, POST vehemently denies any violations. POST has been and remains committed to complying with the Open Meeting Law. As part of the settlement, the Commission agreed to take a refresher training in Open Meeting Law.
POST also agreed to refrain from asking two questions in the form that a court previously preliminarily enjoined. POST does not concede that the line of questioning is unconstitutional or that POST lacks the authority to ask the questions in a different form in the future.
Additionally, POST agreed to a payment of $30,000 to compromise and settle the Plaintiffs’ request for attorney’s fees and litigation expenses and costs. Any payment would be made from the statewide Settlements and Judgments Fund.“
