Note: This form does not apply to officers whose status is “not certified – excused leave” due to administrative, injury, military or family leave. If you received a notice from the Commission that you are not certified because you are on extended leave (medical, military, family or administrative), please do not use this petition process. Instead, when you return to full duty, you must notify the Commission via email at:  [email protected]. and provide your name, Acadis number, and date of return to full duty.

Pursuant to 555 CMR 7.10, you may submit a written petition to the Executive Director requesting review of the decision by the Division of Certification declining to grant full recertification. This includes the ability to petition for the Executive Director’s review of a decision to grant conditional certification.

You are required to file a petition for review by the Executive Director within 21 days of receiving a notice of denial of full certification or recertification from the Division of Certification in order for the petition to be considered.

A petition submitted to the Commission by 11:59:59 P.M. on a business day will be considered filed on that date. A petition submitted on a Saturday, Sunday, or legal holiday will be considered submitted the next business day. A petition sent by mail will be deemed submitted on the date on which it is postmarked.

You must prepare and attach the following documents with your petition:

  • Notice of denial of full certification or recertification.
  • Any documentation that you submitted to your agency or to the Commission as part of the process of applying for certification or recertification.
  • A statement of reasons why the decision not to grant you certification or recertification should be reviewed. (For example, if the Division of Certification decided that you do not possess good moral character and fitness for employment as a law enforcement officer, you should explain why you do in your written statement.) 
  • Any relevant information related to your petition that you think would be helpful for the Commission to have and review.

There is no associated fee for filing for review with the Executive Director.

A petition sent by mail will be deemed submitted on the date on which it is postmarked.
